These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Slumberkiddies, governing your access to and use of the website located at www.slumberkiddies.com (the "Site"), including any content, functionality, and services offered on or through the Site, as well as the purchase of any products from our online store.

By accessing this Site, browsing our pages, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site immediately.

2. Eligibility and Account Responsibilities

By using this Site, you represent and warrant that:

You are responsible for maintaining the confidentiality of any account credentials associated with your use of the Site. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately at support@slumberkiddies.com if you become aware of any unauthorized use of your account or any other breach of security.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including but not limited to cases where we believe that customer conduct violates applicable law, is fraudulent, or is harmful to our interests or the interests of other customers.

3. Products and Availability

All products displayed on the Site are subject to availability. We make reasonable efforts to keep our inventory and product listings current; however, product availability may change without notice due to supply chain fluctuations, seasonal demand, manufacturer decisions, or other factors beyond our control.

We reserve the right to:

Limit quantities available for purchase per customer or per order;
Discontinue any product at any time without prior notice;
Refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity;
Modify product specifications, features, materials, colors, dimensions, or packaging at any time without prior notice.

Product images displayed on the Site are for illustrative purposes only. While we strive for accuracy, actual products may vary slightly in color, texture, or appearance due to differences in screen display settings, photography, or manufacturing processes. Such variations do not constitute defects and are not grounds for return or refund.

4. Pricing, Payments, and Order Acceptance

4.1 Pricing

All prices listed on the Site are displayed in United States Dollars (USD) unless otherwise indicated by a currency selector at the time of checkout. Prices are inclusive of the listed product cost but do not include shipping fees, handling charges, duties, customs fees, or applicable sales taxes, which will be calculated and displayed during the checkout process prior to order confirmation.

We reserve the right to change prices for products displayed on the Site at any time and without prior notice. Price changes will not affect orders that have already been confirmed and processed. In the event of a pricing error—whether due to a technical glitch, typographical mistake, or incorrect information received from our suppliers—we reserve the right to cancel or modify any orders placed at the incorrect price. If your order is affected, we will notify you and offer you the option to proceed at the corrected price or receive a full refund.

4.2 Payments

We accept major credit and debit cards as well as other payment methods as displayed during the checkout process, subject to availability. All payment processing is handled by trusted third-party payment processors. We do not store your full credit card information on our servers.

By submitting an order, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total order amount, including product cost, applicable taxes, shipping, and any other fees disclosed at checkout.

4.3 Order Acceptance

Your receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason at any time after receipt. Order acceptance occurs only when your order has been shipped and you receive a shipment confirmation email with tracking information. In the event that we cancel an order after payment has been collected, you will receive a full refund to your original payment method.

4.4 Promotional Offers and Discount Codes

From time to time, we may offer promotional pricing, discount codes, or special offers. Unless otherwise stated, promotional offers are non-transferable, cannot be combined with other offers, and are valid only for a limited time. We reserve the right to modify or discontinue any promotional offer at any time. Abuse of promotional codes, including but not limited to the use of automated tools to generate or exploit codes, may result in order cancellation and account suspension.

5. Membership: Trial and Subscription Terms

Membership Program

We offer a optional subscription-based membership program, referred to as "Subscription," which grants members access to benefits including exclusive member pricing, a monthly forty-dollar discount card, priority customer support, early access to new product releases, and member-only deals and promotions. These benefits are governed by the terms outlined in this section and as presented at the time of enrollment. We may update the promotional terms of the Membership program from time to time; however, any increase in the subscription fee will be communicated to you in advance, giving you the opportunity to cancel before the change takes effect. From time to time, additional offers or perks may be made available to members, the details of which will be provided during checkout or via email.

20-Day Complimentary Trial

New members are eligible for a complimentary twenty (20) day free trial of the Membership program. During this trial period, you will not be charged any membership fees; however, any products purchased during the trial will be charged at the applicable price. To begin the trial, valid payment information is required at the time of enrollment. Unless cancelled as described below, the membership fee of twenty-nine dollars and ninety-nine cents, will be automatically charged to your payment method at the conclusion of the twenty (20) day trial period.

Automatic Billing and Renewals

At the end of your free trial, your payment method on file will be charged the standard Membership fee of twenty-nine dollars and ninety-nine cents, excluding applicable taxes. The Membership will then automatically renew every thirty (30) days, with the fee charged to your payment method at the start of each new billing cycle, until you choose to cancel. You are responsible for keeping your payment information current. If a payment fails due to an expired, declined, or otherwise invalid payment method, we may suspend or cancel your Membership and its associated benefits without prior notice.

Cancellation Policy

You may cancel your Membership at any time by emailing us at support@slumberkiddies.com. To avoid being charged after the free trial, your cancellation must be submitted before the end of the twenty (20) day trial period. For active paid subscriptions, cancellation requests must be received at least three (3) days prior to your next billing date to prevent charges for the upcoming cycle. Please include your full name and the email address associated with your account in your cancellation request. Upon cancellation, you will continue to have access to Membership benefits, including any unused discount card balance, until the end of your current paid billing period, after which all benefits will cease.

Refunds

Membership fees are generally non-refundable. If you believe you were charged in error or did not authorize a renewal, please contact us at support@slumberkiddies.com within seven (7) days of the charge and we will review your request.

Suspension and Termination

We reserve the right to suspend or terminate your Membership at any time if we determine that you have violated these Terms, engaged in fraudulent activity, or misused Membership benefits, including but not limited to reselling discount cards or sharing member pricing with non-members. In the event of termination for cause, no refund of the current billing cycle fee will be issued.

6. Shipping and Delivery

5.1 Processing Times

Orders are typically processed within one (1) to three (3) business days after payment confirmation, excluding weekends and U.S. federal holidays. Orders placed after 2:00 PM EST may not begin processing until the following business day. During peak seasons, promotional events, or periods of high demand, processing times may be extended.

5.2 Delivery Timeframes

Standard delivery within the contiguous United States typically takes five (5) to twelve (12) business days from the date of shipment. Delivery times to Alaska, Hawaii, U.S. territories, and international destinations may vary and are subject to additional fees. All estimated delivery dates provided at checkout or in confirmation emails are approximations and are not guaranteed.

5.3 Shipping Carriers

We ship via reputable third-party carriers and fulfillment partners. Once your order has shipped, you will receive a confirmation email containing a tracking number and a link to track your package. Please note that tracking information may take 24–72 hours to update after shipment.

5.4 Risk of Loss

All items purchased from the Site are shipped pursuant to a shipment contract. Title to, and risk of loss for, such items passes to you upon delivery of the items to the carrier. We are not responsible for delays, damage, or loss caused by the shipping carrier once the package has left our fulfillment facility. If your package is lost or damaged in transit, please contact our support team and we will assist you in filing a claim with the carrier or finding an appropriate resolution.

5.5 International Shipping

For orders shipped outside of the United States, you are responsible for all customs duties, import taxes, brokerage fees, and other charges imposed by the destination country. These charges are not included in the product price or shipping cost and are your sole responsibility. We are not responsible for delays caused by customs clearance processes.

7. Returns, Exchanges, and Refunds

6.1 Return Eligibility

We offer a thirty (30) day return window from the date of delivery. To be eligible for a return, items must be:

Unused, unwashed, and in their original condition;
Free from damage, stains, odors, or signs of wear;
In their original packaging with all tags, labels, and accessories intact.

We reserve the right to refuse returns that do not meet these criteria or to issue a partial refund at our discretion if an item is returned in a condition that diminishes its resale value.

6.2 Non-Returnable Items

Certain items are not eligible for return, including but not limited to:

Items marked as "Final Sale" or "Non-Returnable" at the time of purchase;
Personalized, custom-made, or monogrammed products;
Gift cards and digital products;
Items that have been used, altered, washed, or damaged by the customer.

6.3 Return Process

To initiate a return, please contact our support team at support@slumberkiddies.com with your order number and reason for return. Our team will provide you with return instructions and, if applicable, a prepaid return shipping label. Return shipping costs may be deducted from your refund unless the return is due to our error (e.g., wrong item shipped, defective product).

6.4 Refund Processing

Once your returned item has been received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be credited to your original payment method within five (5) to ten (10) business days. Please note that your bank or credit card company may take additional time to process the refund to your account. Shipping costs are non-refundable unless the return is the result of our error.

6.5 Exchanges

If you wish to exchange an item for a different size, color, or style, please contact our support team. Exchanges are subject to product availability. If the requested item is unavailable, we will process a refund for the original item.

8. Accuracy of Information

We make reasonable efforts to display accurate product information, including descriptions, specifications, images, pricing, and availability. However, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.

In the event of an error, we reserve the right to correct any inaccuracies and to update information on the Site at any time without prior notice. This includes the right to correct errors in pricing or product descriptions after an order has been placed, and to cancel or refuse any order based on incorrect information. If your order is affected, we will contact you to offer alternatives or a full refund.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SLUMBERKIDDIES AND ITS RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES (COLLECTIVELY, THE "COMPANY PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

You agree to indemnify, defend, and hold harmless the Company Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of the Site or any products purchased through the Site; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party rights; or (d) any content or information you submit, post, or transmit through the Site.

All content on the Site, including but not limited to text, product names, product descriptions, graphics, photographs, images, illustrations, logos, trademarks, service marks, trade dress, page headers, button icons, scripts, and software (collectively, "Content"), is the exclusive property of Slumberkiddies (or its content suppliers and licensors) and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for personal, non-commercial purposes only. You may not:

Reproduce, distribute, modify, display, perform, prepare derivative works of, republish, download, store, or transmit any Content without our prior written consent;
Use any data mining, robots, scraping, or similar data-gathering tools on the Site;
Use the Site or its Content for any commercial purpose without our express written authorization;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Site or its Content.

Any unauthorized use of the Content may violate copyright, trademark, and other applicable laws, and could result in civil or criminal penalties.

14. Privacy and Data Protection

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY PARTIES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SITE OR ITS PRODUCTS WILL BE ACCURATE OR RELIABLE.

16. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at support@slumberkiddies.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. Most customer concerns can be resolved quickly and to your satisfaction through our support team.

15.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Sheridan County, Wyoming, or at another mutually agreed-upon location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND SLUMBERKIDDIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and we agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.

15.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, and you waive any objection based on forum non conveniens or any other objection to the exercise of jurisdiction by such courts.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, epidemics, government actions, embargoes, war, terrorism, labor disputes, supply chain disruptions, carrier delays, power failures, internet or telecommunications failures, cyberattacks, or any other event of force majeure.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Slumberkiddies regarding your use of the Site and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us with respect to the Site.

21. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by an authorized representative of Slumberkiddies.

22. Assignment

You may not assign, delegate, or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder without restriction and without notice to you.

23. Electronic Communications

By using the Site or placing an order, you consent to receive electronic communications from us, including order confirmations, shipping notifications, promotional emails, and other communications related to your account and purchases. You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.

You may opt out of promotional communications at any time by clicking the "unsubscribe" link in our emails or by contacting us at support@slumberkiddies.com. Please note that opting out of promotional communications does not affect transactional communications related to your orders.

We reserve the right to revise and update these Terms at any time at our sole discretion.
